Terms & Conditions

Last updated: January 2025

1. Scope

These Terms & Conditions apply to all orders placed through the Alexandria online shop (libraryofalexandria.ch). The contracting party is the operator of this shop (see Imprint).

By completing a purchase you fully accept these Terms & Conditions.

2. Contract Formation

The display of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking "Proceed to checkout" you place a binding order.

The purchase contract is concluded when we confirm your order by email or when payment is successfully processed.

3. Prices and Payment

All prices are final prices in Euros (EUR) including shipping costs. As a small Swiss business under MWSTG Art. 10 para. 2, no VAT is charged.

Buyers outside Switzerland may be subject to import duties or local taxes depending on their country. These costs are borne by the buyer.

Payment is processed exclusively via Stripe (credit/debit card). Your card is charged at the time of ordering.

4. Delivery

We ship to Switzerland, all EU/EEA countries, and the United Kingdom. In-stock orders are dispatched within 3–5 business days of payment.

For made-to-order devices the delivery time is 2–3 weeks. We will notify you by email when your order ships.

Risk of loss passes to the buyer upon handover to the shipping carrier.

5. Right of Withdrawal (EU buyers)

Buyers residing in the European Union have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days from the day you or a third party designated by you takes physical possession of the goods.

To exercise your right of withdrawal, notify us (info@libraryofalexandria.ch) by means of a clear statement of your decision to withdraw from this contract.

If you withdraw, we will reimburse all payments received from you, including delivery costs, without undue delay and no later than 14 days after we receive the returned goods. The cost of returning the goods is borne by the buyer.

6. Voluntary Commercial Warranty (1 Year)

In addition to your statutory rights, we provide a voluntary Alexandria Warranty of 1 year from the delivery date.

This warranty covers manufacturing and material defects arising under normal, intended use. The same exclusions apply as for the statutory warranty (see below).

Within the first year we accept the burden of proof as to whether a defect existed at the time of delivery. After the first year, statutory rules on burden of proof apply.

This voluntary warranty does not affect your statutory rights, which exist independently.

7. Statutory Warranty

A statutory warranty of 2 years from the delivery date applies in accordance with Swiss law (OR Art. 197 et seq.). EU buyers are also covered by the EU Consumer Sales Directive (2 years).

The warranty covers defects in materials and workmanship that existed at the time of delivery. After 12 months from the delivery date, the buyer bears the burden of proving that the defect existed at the time of delivery.

The following are explicitly excluded from the warranty:

  • Physical damage caused by drops, impacts, or shocks
  • Cracked or broken screen or casing
  • Water damage or damage caused by moisture
  • Damage caused by use of non-recommended power supplies or powerbanks
  • Unauthorised hardware or software modifications
  • Normal wear and tear (e.g. battery capacity degradation)
  • Damage caused by misuse or failure to follow operating instructions

For valid warranty claims you are entitled to repair or replacement. Contact info@libraryofalexandria.ch with a description of the defect and proof of purchase.

8. Limitation of Liability

Alexandria is not liable for damages caused by force majeure, improper use, or third parties. Liability for slight negligence is excluded unless essential contractual obligations are breached.

Alexandria accepts no liability for the accuracy, completeness, or currency of content stored on the device (Wikipedia, OpenStreetMap, Project Gutenberg texts). These contents are provided by third parties under their own licences.

9. Privacy

Information about the processing of personal data can be found in our Privacy Policy.

10. Governing Law and Jurisdiction

Swiss law applies exclusively. For consumers in the EU, mandatory consumer protection provisions of the relevant EU member state remain unaffected.

The place of jurisdiction for buyers who do not have a general place of jurisdiction in Switzerland is the registered seat of the seller (Switzerland).

11. Dispute Resolution

The European Commission provides an online dispute resolution platform: ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
